Overview Murweh Shire Council is inviting tenders for the sale of 14 vacant industrial lots within the Bollon Road Industrial Estate, Charleville. Important Information for Tenderers Planning Requirements The lots are currently located within the Township Zone under the Murweh Shire Planning Scheme. The land is being sold for industrial use only, and sensitive land uses, including residential and caretaking uses, will not be permitted. Under the current planning scheme, purchasers will need to apply for an impact assessable Material Change of Use approval before commencing use of the land. Council has prepared a draft Planning Scheme (Version 3). If the draft planning scheme commences in its current form, the lots would be included in a new Industry Zone, with a Material Change of Use for an industrial use being code assessable rather than impact assessable. The draft Planning Scheme has not commenced and remains subject to public consultation and State review. Council makes no representation or warranty as to whether or when the draft Planning Scheme will commence, or what zoning, assessment categories or assessment benchmarks may ultimately apply. Tenderers must not rely on the draft Planning Scheme and should make their own enquiries and satisfy themselves as to the planning controls applying to the land, both under the current Planning Scheme and any planning scheme that may replace it. Services The lots are not connected to power, water, sewerage or other services, and Council has no intention of connecting services to the lots. Non-potable water may be available on application, but potable water is not available to the lots. Power and communications may be available by application to the relevant service provider. There is no reticulated sewerage available to the lots. All connection and on-site servicing costs are the sole responsibility of the purchaser. Council makes no representation or warranty regarding the availability, quality, cost, timing, capacity or adequacy of any service, including the suitability of any non-potable water supply. Tenderers must undertake their own enquiries and satisfy themselves that services are suitable for their intended use before submitting a tender. Environmental and Site Information The lots are being sold on an "as is, where is" basis. Tenderers should conduct their own due diligence regarding the condition of the land and any environmental matters before submitting a tender. The land within the Bollon Road Industrial Estate was previously dedicated as the town's refuse site and was used as a landfill for the disposal of household and commercial refuse, including debris from the April 1990 Charleville flood. A number of the lots are recorded on the Environmental Management Register (EMR) for Notifiable Activity 20 (Landfill). The affected lots include Lots 7, 8, 9, 12, 13, 14, 15, 16, 17 and 20. Council has also lodged an amendment with the Department of Environment, Tourism, Science and Innovation advising that Lots 9, 12, 13, 14, 15, 16, 17 and 20 have also been subject to Notifiable Activity 3 (Asbestos Manufacture or Disposal), and that these lots are impacted by elevated levels of hazardous contaminants including lead, zinc and asbestos, both friable and bonded. Council has also lodged notification that Lots 2, 3, 4, 5 and 6 should be recorded on the Environmental Management Register due to their inclusion within land previously used as the town's refuse site and their use for landfill. Tenderers should therefore assume that Lots 2, 3, 4, 5 and 6 will be listed on the EMR and should undertake their own enquiries regarding the implications of EMR listing, including any future site management obligations. Tenderers should carefully review the Notices to Buyers and all environmental information contained within the Request for Tender documentation. Building and Landfill Gas Risk Any buildings or structures on the land incorporating a slab-on-ground or similar construction method will be subject to a landfill gas risk assessment, to be undertaken at the purchaser's cost. Due Diligence Prospective purchasers should carefully review the complete Request for Tender documentation before submitting a tender. Tenderers are responsible for undertaking their own investigations and due diligence, including in relation to: Planning and development requirements Zoning and assessment categories Environmental matters and EMR listings Site conditions Landfill and potential landfill gas Contamination and hazardous materials Availability and suitability of services Costs associated with connecting or providing services Any other matters relevant to their proposed use of the land Council makes no representation or warranty regarding the suitability of any lot for a tenderer's proposed use. Instructions to Tenderers Late tenders will not be considered. A tender submitted by email is not considered received until it arrives in Council's mailbox and is sent at the tenderer's risk.
