Council requires the development of one consolidated, risk-based Environmental Monitoring and Response Plan, with site-specific schedules for Lochlees, Tieri and Blackwater. The Plan consolidates, into a single practical operating control, the monitoring, environmental risk management, response and record-keeping obligations arising under the EA, the Environmental Protection Act 1994 and the Environmental Protection Regulation 2019. It must state what must be monitored, where, why those points are appropriate, what parameters and frequency apply, what trigger values apply, what happens when a trigger is exceeded, who is responsible, what records must be kept, and when the regulator may need to be notified. The Plan addresses environmental monitoring and response while the sites remain active. The outcome sought is a defensible monitoring and response system that Council owns and can operate. Scope: The Consultant must prepare a consolidated Plan and three site-specific schedules covering, at minimum: • an EA condition cross-reference matrix mapping each applicable EA condition to the relevant Plan section and site schedule; • a determination of the monitoring required at each site (clause 4.1) and validation of the groundwater conceptual site model (clause 4.2); • a review of the previous site documents and available data to characterise each site and the requirements previously considered, noting groundwater records are sparse (site context, not the basis for the monitoring required); • at least one site inspection at each of the three sites (Lochlees, Tieri and Blackwater), with photographic records and a review of the monitoring points, drainage controls and site constraints; • a site-specific environmental risk assessment for each site addressing groundwater, stormwater/surface water, leachate, landfill gas and nuisance (odour, dust, litter, noise, smoke, pests, birds, vectors), on a source–pathway–receptor basis; • a landfill gas risk screening for each site, with a recommendation on whether routine monitoring or further assessment is required; • a Trigger Action Response Plan with alert / investigation / action levels and, for each trigger, a defined response, responsible owner and escalation path (corporate framework plus site-specific TARPs); • a regulator notification decision tree distinguishing operational corrective action from matters that may require notification under the EA and the EP Act duty to notify; • a complaint and incident response process, and record-keeping requirements aligned to the EA retention obligations and Council’s systems of record; • a prioritised implementation plan and a mandatory-versus-recommended action register, risk-rated and aligned to CHRC’s corporate risk framework; • an implementation pack of operational templates, checklists and registers; • GIS-ready / editable site plans for each site (static screenshots are not acceptable); • an implementation briefing / knowledge transfer session; and • editable final documents (Word) in addition to PDF. Throughout, the Consultant must distinguish: (1) mandatory EA or legislative requirements; (2) actions required to demonstrate compliance or manage material risk; (3) risk-based recommended improvements; and (4) discretionary good-practice improvements.
